Institutional arbitration
Arbitration is a procedure in which the dispute is submitted, by agreement of the parties, to one or more arbitrators, who make a binding decision on the dispute. By choosing arbitration, the parties opt for a private dispute resolution procedure instead of going to court. mizan's institutional arbitration is conducted under mizan's 2016 Arbitration Rules, which are based on the UNCITRAL Arbitration Rules of 2010.
The purpose of these Rules is to provide a system of mizan-administered arbitration in respect of disputes arising out of contracts or any other legal relationship. Mizan does not itself resolve disputes. However, it administers the resolution of the disputes by the arbitrators in accordance with its Rules.
The main functions of mizan include receiving case filings, administering the exchange of written submissions and documents, appointing arbitrators in accordance with its Rules, monitoring the arbitrators' compliance with the Rules and applicable laws, scrutinizing and approving the arbitral awards, and providing facilities for hearings, among others.
